Pretrial hearing set for Waynesburg man accused in assault attempt

A Waynesburg man accused of attempting to sexually assault a Greene County Department of Human Services employee in May is preparing to go to trial in the case.

The commonwealth did not make a plea offer to Timothy Hilverding, 36, his attorney, Timothy Ross, said at a plea court hearing Tuesday morning.

Hilverding will next appear in court for a pretrial hearing Oct. 1, when he will also undergo a probation violation hearing, stemming from a 2023 criminal trespass case.

The state Attorney General’s office had handled prosecution of the case in its early stages. While there had been discussions at earlier hearings that the case would be returned to the Greene County District Attorney’s Office, no formal action had been taken yet, court staff said.

Judge Lou Dayich directed the district attorney’s office to communicate with the state Attorney General’s office for a “seamless transition.”

Hilverding went to the offices at the county’s Fort Jackson building on May 7 to speak with someone at housing services. When an employee took him into a conference room, he began behaving lewdly and attempted to assault the employee before a co-worker in an adjacent room intervened, according to court documents.

As part of a security review conducted after the incident, the county board of commissioners voted last week to purchase new secure access doors for Fort Jackson and Ben Franklin buildings.

Hilverding is incarcerated in the Fayette County jail. Bond was denied in the case due to the seriousness of the offense.

A trial date has not been set. Dayich said a trial in the case would be expected to last two days.
